Terms of use

1. Purpose

These terms set out the rules for using Boki.ma, an online appointment-booking service designed, hosted and operated by SEM AGENCY (Morocco), as well as the rights and obligations of SEM AGENCY and of user businesses.

Boki.ma provides each business with a public booking page (<name>.boki.ma) and a dashboard (boki.ma/dashboard) including the diary, appointments, client or patient files with notes and documents, the cash desk with receipts, team management, notifications and e-mails.

2. Account creation

To use Boki.ma, the business must create an account and provide accurate, complete and up-to-date information about its identity, activity and contact details.

The business agrees to update this information whenever it changes. The person creating the account declares that they are authorised to act on behalf of the business.

Any false or misleading information may lead to the suspension or closure of the account.

3. Account validation

The Boki.ma team may check new accounts and request additional information before or after activation.

SEM AGENCY reserves the right to refuse, suspend or ban an account in case of fraud, abuse, use contrary to these terms or non-payment.

4. Credentials and team access

The business is responsible for keeping its credentials and those of its team members confidential. It sets each member’s access rights from its dashboard.

Any action performed from an account is deemed to have been performed by the business. If unauthorised use is suspected, the business must change its passwords and notify support@boki.ma without delay.

5. Responsibilities of the business

The business is solely responsible for the content of its public page (texts, photos, services, prices, opening hours) and for its accuracy.

It is responsible for its relationship with its own clients or patients: quality of services, keeping appointments, prices charged, payments and complaints.

It agrees to obtain its clients’ or patients’ consent where required, to respect the medical or professional secrecy applicable to its activity and to use Boki.ma in accordance with applicable laws, including Law No. 09-08.

6. Acceptable use

It is forbidden to use Boki.ma to send unsolicited messages (spam), to publish illegal, defamatory, misleading or offensive content, or to impersonate any person or business.

It is also forbidden to attempt to bypass security measures, to access other businesses’ data, to disrupt the service or to use it for fraudulent purposes.

Any breach may lead to the removal of the content concerned and the suspension or banning of the account, without prejudice to any legal action.

7. Packs and free trial

Boki.ma offers two packs, Plus and Pro, billed monthly or yearly. The content and prices of each pack are shown on boki.ma.

A free trial period is offered to new accounts. At the end of the trial, continued use requires subscribing to a pack.

Prices may change. Any change is announced in advance and applies from the next billing period.

8. Payment and suspension

Packs are paid by bank transfer, following the instructions provided by Boki.ma.

When the paid period ends, the business has 5 extra days to settle its payment. After this period, access to the dashboard and the public page is suspended until payment is received.

Suspension does not cause the immediate deletion of data, which becomes accessible again once payment is made.

9. Personal data

For the data of its clients or patients, the business is the data controller and SEM AGENCY acts as processor on its instructions. For account data, SEM AGENCY is the data controller.

Processing details are set out in the privacy policy and in the confidentiality agreement, which form an integral part of these terms.

10. Service availability

SEM AGENCY makes its best efforts to keep Boki.ma continuously available. The service may, however, be temporarily interrupted for maintenance, updates or events beyond our control.

Wherever possible, planned maintenance is carried out at off-peak times and announced in advance.

11. Intellectual property

The Boki.ma software, brand, logo, design and all related elements belong to SEM AGENCY. No rights are transferred to the business, which only receives a personal, non-exclusive right of use for the duration of its subscription.

The business retains full ownership of its content (texts, photos, logo, data). It authorises SEM AGENCY to host and display it solely to the extent necessary to provide the service.

12. Limitation of liability

SEM AGENCY is not responsible for the relationship between the business and its clients or patients, for the services provided by the business or for the content it publishes.

SEM AGENCY cannot be held liable for indirect damage, such as loss of revenue, clients or opportunities, resulting from the use of or inability to use the service.

In all cases, SEM AGENCY’s liability is limited to the amount paid by the business for the current pack at the time of the events.

13. Termination

The business may stop using Boki.ma and request the closure of its account at any time by writing to support@boki.ma. Amounts already paid for the current period are not refunded, unless otherwise stated.

SEM AGENCY may terminate an account in case of serious breach of these terms, fraud or prolonged non-payment.

After closure, data is deleted or anonymised within a reasonable time, subject to legal retention obligations.

14. Changes to the terms

SEM AGENCY may amend these terms to reflect changes to the service or to regulations. Businesses are informed of significant changes by e-mail or through the dashboard.

Continuing to use Boki.ma after the new terms come into force constitutes acceptance of them.

15. Applicable law and jurisdiction

These terms are governed by Moroccan law.

In the event of a dispute, the parties will first seek an amicable solution. Failing that, the dispute will be submitted to the competent courts of Casablanca.
